Folkman LLC values and respects your privacy. This means that:

  • We clearly state the purposes for which we process your personal data. We do this by means of this privacy statement.

  • We take appropriate security measures to protect your personal data, and we require third parties that process personal data on our behalf to do the same.
  • We respect your right to access your personal data or to have it corrected or deleted, at your request.

Purpose, Data, and Retention Period

We collect personal data that you submit via our contact form, which is hosted on our own server, or via our “request a consultation” form, which is hosted by Clio Grow, a law firm management tool offered by Themis Solutions, Inc. You can find the Clio privacy policy here.  The data we collect in these forms includes name and address, email address, telephone numbers, the content of the message you send us, and the names of adverse parties. We use this information to respond to your messages and to do an initial screening for conflicts of interest before scheduling a consultation with you. Our basis for processing these data is your consent. We retain messages that you send via our contact form for two years, unless the law requires us to retain them for longer in a particular case, and we retain messages that you send via our “request a consultation” form indefinitely.

If you use our website to subscribe to our newsletter, we collect your email address. We use Mailpoet to send our email newsletters. Mailpoet is part of Automattic, Inc., whose privacy policy can be found here. The data we collect for this purpose includes your email address. Mailpoet also tracks whether you have opened our newsletter or clicked on links it contains. We use this information to provide you with the newsletter you requested and to monitor the success of our newsletters for purposes of improving them. Our basis for processing these data is your consent. We retain your email address for as long as you subscribe to our newsletter, but you can unsubscribe at any time, and we delete your email address within fourteen days of an unsubscribe. 

We collect anonymized web analytics data in order to help us understand how users are using the website and to make improvements to it. For this purpose, we use Google Analytics. We do not collect your IP address. We do collect information about your visit to the website and your geolocation. We also use Google’s reCaptcha service to minimize spam. This service collects information about your web usage, including cookies placed by Google, information about your web browsing, the date, your language, plugins you have installed on the browser, and other technical information necessary to allow reCaptcha to function. We use Wordfence, a service of Defiant, Inc., to provide a web application firewall and other security for this website. Wordfence may have access to your IP addresss, geolocation data, data concerning your use of our website, and other technical information about your visit. Wordfence’s privacy policy is here.

Disclosure and Third Parties

Except as required by law, or as explained here, we do not disclose or sell your personal data to anyone. 

The third-party services we use to operate the website (Google Analytics, Google Recaptcha, Mailpoet, Wordfence, and Cloudflare) may have access to your personal data as described above and handle it in accordance with their privacy policies.

Security

We take the security of this website and your personal data seriously. We use appropriate security measures to try to prevent abuse and unauthorized access to your personal data. We review our security measures periodically.

Except as required by law, or as explained here, we do not disclose or sell your personal data to anyone.

Accessing and Modifying your Data

If you have questions or want to know what personal data we have that concerns you, please contact us. We will provide you with an explanation of why we need your data, what will happen to it, and for how long we will keep it. We will also provide you with access to any of your personal data, and if you find that there is an error, we will supplement, correct, or delete it at your request. If you have consented to sharing your data with us, you may revoke that consent by getting in touch with us, in which case we will delete the data. We will also transfer your data to another person or entity at your request. If you object to our processing of your data, we will honor your objection unless there are justified grounds for the processing.  If you do communicate with us on these matters, please provide us with full and accurate information, s that we can be sure we are not modifying or deleting the data of the wrong person.

Complaints

If you have a complaint about our handling or processing of your personal data, you have the right to submit a complaint to the data protection authority in your jurisdiction.  Because we are not engaged in large scale, regular monitoring of data subjects or in processing special data categories on a large scale as part of our core activities, we have not appointed a data protection officer.
