Lago Agrio: Canadian Supreme Court’s Judgment To Be Delivered On Friday

On Friday at 9:45 a.m. EDT, the Supreme Court of Canada will deliver its judgment in Chevron Corp. v. Yaiguaje. It’s been a while, so as a reminder, this is the case in which the LAPs are seeking recognition of the Ecuadoran judgment in Canada.

Because the Canadian Supreme Court, unlike the US Supreme Court, announces in advance that it will be delivering judgments, it’s possible to do a little planning and prepare some expert commentary on the decision to appear on Friday or as soon thereafter as may be. On the other hand, we don’t know what kind of decision it is going to be. Will it be a decision about Canadian corporate law, with limited implications and interest for us? Or will it, on the other hand, be a sweeping decision about comity and the grounds on which a court should refuse recognition of foreign judgments? Or something else altogether? Either way, I expect to have reaction from a fine group of Canadian lawyers and others, so check back in on Friday!
